COURT CLEARS PATH FOR MAHDIA FIRE LAWSUIT

HGP Nightly News – Parents of children who died in the devastating Mahdia Secondary School dormitory fire have secured a significant legal victory after Chief Justice Navindra Singh dismissed applications seeking to strike out their claims against the State.

The ruling allows the parents’ case to proceed, paving the way for a full judicial examination of allegations that constitutional rights were violated and that the State acted negligently in relation to the tragedy that claimed the lives of several students.

According to Attorney-at-Law Darren Wade, the parents argue that their deceased children were denied constitutional protections and that the State bears responsibility for circumstances surrounding the fatal fire.

The families are also challenging compensation agreements they reportedly signed following the tragedy. According to the claims, each agreement was valued at approximately $5 million, but the parents contend they entered into those arrangements without the benefit of independent legal advice.

Attorney General Anil Nandlall had sought to have the legal proceedings struck out before a full hearing could take place.

However, Chief Justice Singh found that the issues raised by the parents could not be resolved solely by examining the compensation agreements and instead required a comprehensive review of the evidence.

“I believe we have now a mixed bag of substantial questions of law and fact that require much more than an agreement waived to determine all of these issues,” the Chief Justice said in dismissing the applications.

The ruling means that the court will now examine the wider circumstances surrounding the claims, including allegations of negligence and breaches of constitutional rights.

As part of the decision, the Chief Justice ordered that the proceedings be converted into Statements of Claim and established timelines for the filing of the necessary legal documents.

The move formally advances the matter into the next stage of litigation and sets the stage for what could become one of the most closely watched civil cases arising from the Mahdia dormitory disaster.

The case stems from the tragic fire at the Mahdia Secondary School girls’ dormitory, which shocked the nation and triggered widespread calls for accountability, improved safety measures and a thorough examination of the circumstances that led to the loss of young lives.

With the State’s attempt to halt the proceedings now unsuccessful, the parents will have an opportunity to fully present their claims before the court as the legal battle enters a new phase.
