AG WARNS DECISIVE STEPS WILL BE TAKEN TO RECOVER  $4M OWED BY FGM

Attorney General and Minister of Legal Affairs, Anil Nandlall, has issued a firm warning to the Forward Guyana Movement (FGM), stressing that decisive action will be taken to recover the $4 million in court costs owed to the State and the Guyana Elections Commission (GECOM), following the dismissal of the party’s case last month.

The Court of Appeal had ordered FGM to pay the sum by November 14, 2025, after dismissing the challenge it had filed against GECOM and the Attorney General. However, more than a month later, that payment remains outstanding.

Speaking on his weekly programme, Issues in the News, the Attorney General confirmed that FGM has failed to pay the ordered costs.

“If these sums are not paid, decisive steps will promptly be taken to recover this sum of money,”

Nandlall revealed that formal letters have already been dispatched to Attorney Vivian Williams, who represented FGM, as well as to the party’s complainant, demanding compliance with the Court’s ruling.

“We have sent out letters demanding payment in compliance with the order… It’s $2 million to the Attorney General and $2 million to GECOM — that’s $4 million,”

Background of the Case

On October 2, the Court of Appeal dismissed FGM’s challenge against GECOM. In delivering the ruling, the Chancellor of the Judiciary (ag.) Roxane George noted that the application was filed less than two days before members of the Disciplined Services were due to vote.

She ruled that FGM’s claim effectively sought to question the validity of the elections, a matter that can only be addressed through an election petition under Article 163 of the Constitution. Because FGM did not file an election petition, the Court found it had no jurisdiction.

Furthermore, the Court found that FGM was not denied access to the ballot, noting that the party had chosen not to contest all 10 constituencies, despite being afforded the opportunity.

With the November 14 deadline fast approaching, the Attorney General has signalled that the State will not hesitate to use legal mechanisms to recover the outstanding $4 million.
